Welcome to Epic Aircraft! This Privacy Notice describes the privacy practices of Epic Aircraft, LLC (“Epic Aircraft,” “we” or “us”) related to your use of our website epicaircraft.com, our social media channels and other websites we own or operate (collectively, the “Site”), as well as your interactions with Epic Aircraft in any manner (collectively, our “Services”). This Privacy Notice is governed by our Site Terms of Use. BY USING THIS SITE, YOU AGREE TO BE BOUND BY THIS ONLINE PRIVACY NOTICE. If you do not agree with this Privacy Notice, do not use our Site or submit Personal Information to us.

1. Definition of “Personal Information”

As used in this Privacy Notice, “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. We generally describe Personal Information as falling within categories, for example:

  • Identifiers (e.g., name, email address, username, etc.)
  • Sensitive information (e.g., government ID, health data, biometrics, certain demographics)
  • Legally protected information (e.g., race, citizenship, marital status, sex)
  • Employment or educational information
  • Commercial information (e.g., transaction or order history)
  • Internet activity
  • Inferences drawn from other Personal Information to create a profile.

 

Not all information about a person is protected as Personal Information. Information that is publicly available, aggregated (data summaries or reports with identities and Personal Information removed), or anonymized is often exempt from privacy laws.

2. Collection & Use of Personal Information

We collect Personal Information when you use the Site to learn about our aircraft, create or use your account, communicate with us, or submit information through our Careers page. We only collect and use your Personal Information with your consent as informed by this Privacy Notice and freely given by you, if we have a legitimate interest in the collection, or as authorized or required by law. Over the last 12 months, Epic Aircraft has collected and used Personal Information through the Site as follows:

  • Your Epic Pilot or ASC Account. If you are an Epic Pilot or Authorized Service Center (“ASC”), you may create an account on the Site to connect with customer support, order service for your aircraft, and manage your flight logs. When you create your account, we will collect identifiers including your first and last name, email address, phone number, mailing address, and pilot rating (if you have one). Your account will collect and maintain commercial history including from your flight logs, when you order services for your aircraft, and your interactions with our customer service team. We collect this information with your consent, and we use it to provide you with our Services and to support you as an Epic Pilot and aircraft owner or an ASC serving Epic Pilots.
  • Customer Service and Sales Representatives. You have the option to contact us through the Site or our social media channels to connect with your sales representative, customer support, or general inquiries. At the start of each conversation, we generally collect your name, email address, phone number, mailing address and pilot rating to facilitate our response to your inquiry. Any Personal Information you include in your communications with us is provided with your consent. We will use that information to respond to your inquiry, provide you with the services you request, and send you updates. You can unsubscribe from our marketing communications at any time by following the instructions in our emails or by unfollowing our accounts on social media.
  • Call Recording. If you contact us by phone, we may use call recording for quality monitoring, training, or to improve our customer service. You will be notified if your call is being recorded. By staying on the line after receiving the notification, you consent to the call recording. If you do not consent to call recording, you may end the call.
  • Online Store. You can shop for apparel and other goods through our online store. Purchases and payments are processed by Shop. We will receive data related to your purchase history, but we will not process or have access to your payment information.
  • Careers with Epic Aircraft. You can explore Epic Aircraft career opportunities on the Site’s Careers page. To apply for an open position or submit your resumé, follow the links to our external Careers Portal. If you submit application materials to Epic Aircraft, we will collect identifiers like your name and contact information, employment and education information relevant to your application, as well as sensitive or protected Personal Information that you provide on a voluntary basis. If your application progresses to the next phase, we may collect additional Personal Information from you or run a background check subject to our human resources policy.
  • Social Media. If you interact with Epic Aircraft on social media, we will collect identifiers like your username and any other Personal Information that you choose to include in your online interactions with us. We use this information to share information about our company and aircraft and to respond to your inquiries.
  • Your Activity on the Site. Like most commercial websites, our Site uses cookies and related technologies to understand how visitors use the Site. We use cookies to collect technical data about your device like IP address, log information, generalized geolocation when visiting the Site, error messages, and unique device identifiers. You can adjust your settings on the Services or your device or you can install a third-party plugin to block cookies or alert you when a cookie is set, but doing so may prevent you from using some or all of the features on the Services.

 

We only collect, use, retain, and disclose Personal Information as is adequate and relevant to the specific, express purposes described above, as compatible with the context of collection, or as reasonably necessary and proportionate to provide the Services. Additionally, we may use the Personal Information collected through the Site to (i) monitor your compliance with our terms and conditions; (ii) protect the privacy of consumers; (iii) if we believe it is necessary, to identify, contact, or bring legal action against persons or entities who may be causing injury to you, to us, or to others; (iv) comply with a law, regulation, legal process, or court order; or (v) fulfill any other purpose to which you consent.

We will not collect additional categories of Personal Information or use already collected Personal Information for purposes that are materially different, unrelated, or not reasonably necessary or compatible with the original purpose without notice and consent to you as required by law.

3. Children’s Privacy

The Site and our Services is designed for adults. If we learn that we have collected or received Personal Information from anyone under the age of 16, we will delete that information. If you believe we may have received Personal Information from someone under the age of 16, please notify us at info@epicaircraft.com.

4. Disclosure to Third Parties

Epic Aircraft relies on service providers and other third parties to operate our Site and provide our Services. We will only disclose Personal Information to third parties as described in this section, with your permission, or as required by law. Your consent to Epic Aircraft’s privacy practices is also your consent to these third parties accessing and processing your Personal Information as described below. We may disclose Personal Information to:

  • Our Suppliers. If you purchase an aircraft, we will disclose your Personal Information to our suppliers as necessary to register any warranties for which you are eligible.
  • Our Service Providers. We rely on third party service providers to provide certain features on the Site and to support the products and services we offer. For example, we use email and data hosting services, analytics, and payment processors to provide the Site and related Services. We prohibit our service providers from selling or disclosing the Personal Information we provide, and we require all service providers to maintain confidentiality standards and appropriate technical and organizational measures to ensure the security of your Personal Information.
  • Law Enforcement, and other governmental agencies, as permitted or required by law.
  • Other Disclosures, as permitted by applicable law. For example, if we go through a business transition, to comply with a legal requirement or a court order, to prevent fraud or exercise or defend our legal claims, or for any other reason with your consent.
  • Aggregated and Deidentified Information. Epic Aircraft reserves the right to share aggregated, anonymized, or de-identified information about any individuals with nonaffiliated entities for any purpose without restriction.

 

5. Retention of Personal Information

Epic Aircraft retains Personal Information as needed to fulfill the purposes of its collection or to fulfill our internal business purposes. Your account information is retained until you ask us to delete it or for the period required by law, whichever is longer. Personal Information collected for sales or customer service purposes is retained until we determine it is no longer pertinent to our business or you ask us to delete it, whichever occurs first. Cookie data is retained for as little as a few minutes or as long as 24 months. Epic Aircraft reserves the right to retain data for longer periods as required by law or court order or if doing so is critical to our business.

6. Data Security

Epic Aircraft has implemented and maintains reasonable security measures to secure your Personal Information from accidental loss and unauthorized access, use, alteration, and disclosure. All data, including client Personal Information, is stored on secure servers located in the United States. Epic Aircraft confirms that our security measures are appropriate to the volume, scope, and nature of the Personal Information processed and designed to meet our duty of care with respect to your Personal Information. You are responsible for keeping your device access and login information confidential. We cannot guarantee the security of the information you submit while it is in transit over the Internet, and any such submission is at your own risk. You are encouraged to install anti-virus and anti-malware software on your devices and keep all software updated to avoid security risks.

7. Privacy Controls

You can directly control how we collect and use your Personal Information:

  • Your Account. You can access, correct, or update certain Personal Information by logging into your account and saving your changes.
  • Our Emails. We will send you email messages related to your purchase or service and marketing messages you have signed up to receive. You can unsubscribe from our emails at any time by clicking the link at the bottom of any Epic Aircraft email. If you opt out of marketing emails, we may still send you informational messages related to your purchase or other services you have requested.
  • Text Alerts. If you provide us with your wireless number and consent to receive texts from us, we will send you service or appointment alerts and other messages. We will only send you marketing text messages if you opt in to receive them. The number of texts you receive will depend on the information and services you request from us. You can unsubscribe by replying STOP or UNSUBSCRIBE to any of these text messages. Messaging and data charges may apply to any text message you receive or send. Please contact your wireless carrier if you have questions about messaging or data charges.
  • Do Not Track. Do Not Track signals are signals sent through a browser informing us that you do not want to be tracked. Currently, our systems do not recognize browser “do-not-track” requests.
  • Your Device Settings. You can control the data we collect through cookies and related technologies by adjusting your device settings.
  • Block Location Tracking. You can stop all collection of information by an app by uninstalling it. You can also reset your device Ad ID at any time through your device settings, which is designed to allow you to limit the use of information collected about you. You can stop all collection of precise location data through an app by uninstalling the app or withdrawing your consent through your device settings.
  • Privacy Requests. Section 8 lists the privacy rights applicable to the markets we serve. To exercise your rights under applicable privacy laws, or if you want to express concerns, revoke your consent, lodge a complaint, or request information, please submit a privacy request to info@epicaircraft.com.We can only assist with or fulfill a privacy request when we have sufficient information to verify that the requester is the person or an authorized representative of the person about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. We do not charge a fee to process or respond to a verifiable request unless we have legal grounds to do so. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We endeavor to respond to privacy requests in accordance with the requirements of the law applicable to your jurisdiction. If we do not fulfill your request within the legally required timeline, you can appeal our response by contacting info@epicaircraft.com.

 

8. Privacy Rights

Depending on where you reside, you may be entitled to additional controls over your Personal Information. Please note that we only market our aircraft in the United States and Brazil and, as such, this section provides privacy notices to consumers in those markets only. If you reside elsewhere, please do not submit your Personal Information to us.

a. United States Privacy Rights. In the United States, consumer privacy is governed by federal privacy laws covering specific industries or data uses and state privacy laws providing general consumer privacy rights. For example, California, Colorado, Connecticut, Iowa, Nevada, Utah, Virginia, and other states require companies to inform consumers about their privacy rights and provide a method to exercise those rights.

PLEASE NOTE THAT SOME U.S. PRIVACY LAWS DO NOT APPLY TO EPIC AIRCRAFT OR OUR PRODUCTS OR SERVICES. In those cases, the notices in this paragraph are provided as courtesy only. We will respond to and fulfill your request to the extent required by applicable law..

Depending on the state in which you live, you may be entitled to some or all the following privacy rights:

  • Right to Correct. You have the right to correct your Personal Information if it is inaccurate. You can update your account or alert Epic Aircraft that your information is incorrect so we can update it.
  • Right to Deletion. You may request that we delete the Personal Information that we hold about you, with exceptions. If you request deletion, we may permanently delete, deidentify, or aggregate the Personal Information.
  • Right to Access. You can request that we confirm whether we have collected Personal Information about you and provide you with access to that Personal Information. If you request access, we will provide you with copies of the requested pieces of Personal Information in a portable and readily usable format. Please note that we may be prohibited by law from disclosing certain pieces of Personal Information, and we may be limited in the number or frequency of requests we must fulfill.
  • No Selling or Sharing. Some states entitle consumers to opt-out of the sale or sharing of Personal Information or targeted advertising practices. Epic Aircraft does not sell your Personal Information or share Personal Information with third parties for cross-contextual behavioral advertising purposes. If this changes in the future, we will update this Privacy Notice and provide you with a method to opt-out.
  • Limited Use and Disclosure of Sensitive Information. Epic Aircraft does not intend to collect any sensitive information. If you choose to submit sensitive information to us, we will not share it with third parties for any purpose other than providing you with the services you request.
  • No Profiling. Epic Aircraft does use any form of automated profiling.
  • Right to Disclosure. You may request that we disclose information to you about our collection and use of your Personal Information, such as: (i) the categories of Personal Information we have collected about you; (ii) the categories of sources for the Personal Information we have collected about you; (iii) our business purpose for collecting, using, processing, sharing or selling that Personal Information, as applicable; (iv) the categories of third parties with whom we share that Personal Information; and (v) if we sold or shared (as defined by statute) your Personal Information, two separate lists stating: (a) sales or sharing, identifying the Personal Information categories that each category of recipient purchased; and (b) disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained. Certain laws may limit the number or frequency of requests we must fulfill.
  • Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to request certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes.
  • Right to Nondiscrimination. Epic Aircraft will not discriminate against you for exercising your privacy rights. We will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services; (iii) provide you a different level or quality of goods or services; (iv) retaliate against you as an employee, applicant for employment, or independent contractor for exercising your privacy rights; or (v) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services because you exercised a right under applicable privacy laws.

 

b. Brazil Privacy Rights. Please note that Epic’s business activities in Brazil are served by a separate website and marketing materials. This paragraph informs Epic customers residing in Brazil of their privacy rights under the “Lei Geral de Proteção de Dados” (the “LGPD”) and integrates with and supplements the information contained in the rest of this Privacy Notice. As used below, “Personal Information” has the definition given in the LGPD. If you are in Brazil, you have the right to:

  • Confirm the existence of processing activities on your Personal Information.
  • Access to your Personal Information.
  • Update or correct incomplete, inaccurate or outdated Personal Information.
  • Anonymize, block or eliminate your unnecessary or excessive Personal Information, or information that is not being processed in compliance with the LGPD.
  • Learn about your consent options, including options to provide or deny consent for processing and the consequences of those choices.
  • Be informed about third parties with whom we share your Personal Information.
  • Port your Personal Information (except for anonymized information) to another service or product provider upon your request, provided that our commercial and industrial secrets are safeguarded.
  • Delete your Personal Information that is processed based on your consent, with exceptions.
  • Revoke your consent at any time.
  • Lodge a complaint related to your Personal Information with the ANPD (the National Data Protection Authority) or with consumer protection bodies.
  • Oppose a processing activity in cases where the processing is not carried out in compliance with the provisions of the law.
  • Request information that is clear and adequate regarding the criteria and procedures used for an automated decision.
  • Epic Aircraft does not use automated processing. However, the LGPD grants you the right to request the review of decisions made solely based on the automated processing of your Personal Information, which affects your interests. These include decisions to define your personal, professional, consumer and credit profile, or aspects of your personality.
  • Not face discrimination. You will never be discriminated against, or otherwise suffer any sort of detriment, if you exercise your rights.

9. Owned and Operated in the United States

Epic Aircraft headquarters is located in Bend, Oregon, United States. We only market and sell our aircraft to customers located in the United States and Brazil. If you access the Site from outside the United States, you agree that your Personal Information will be transferred to, processed, stored, and used in the United States so that Epic Aircraft may provide the Services to you which you have requested. When your information is moved from your home country to another country, the laws that protect your Personal Information in the country to which your information is transferred may be different from those of the country where you live. For example, if your information is in the United States, it may be accessed by government authorities under United States law.

10. Other Websites and Services

Our Site may offer links to websites and other services offered by third parties. These links are provided for convenience only. Epic Aircraft has no control over these third-party websites and services.

11. Privacy Updates

Epic Aircraft may update this Privacy Notice as needed from time to time. You can see when this Privacy Notice was last updated by checking the “last updated” date displayed at the top of this Privacy Notice. We will notify you about material changes to this Privacy Notice by email or by other measures that are appropriate to provide you with notice. We will collect your consent to these changes to the extent required by applicable law.
